Two Sarah’s Trace residents – already suing the School Department over damage they say was caused by construction of the new Cole Middle School – call police to report new vibrations.
Work to improve drainage on the Cole Middle School softball field, which had flooding problems after the new school opened, prompted two neighbors to call police recently over what they said were house-shaking vibrations. Christopher Lamendola, of 50 Sarah’s Trace, and Thomas Hogan, of 40 Sarah’s Trace, asked police to document their complaints Wednesday, Aug. 8. Both men are part of an ongoing lawsuit filed against the School Department and companies involved in construction of the new Cole. Construction on the new building began in 2009; it opened April 2011. In police reports from Aug. 8, Lamendola and Hogan said their houses, both of which abut the middle school – were vibrating due to use of heavy construction equipment on the fields…

WPRO-AM John DePetro said he will "respond" later today to EG Patch about the allegations.
WPRO-AM radio talk show host John DePetro, who lives in East Greenwich, said he would "respond" to EG Patch about lawsuit filed against him Friday accusing him of sexual harrasment. WPRO colleague Diane (Dee) DeQuattro said in the Superior Court lawsuit that DePetro made sexual advances to her in March after inviting her out for lunch, the Providence Journal and the AP reported Friday. The suit also names corporate parent Cumulus Media; Citadel Broadcasting; DeQuattro's supervisor, Barbara Haynes; and lawyer Nicole Waller. DePetro denied the allegations through his lawyer, Timothy J. Dodd. EG Patch asked DePetro Monday morning for a comment, via Twitter direct message. He responded, "Yes I will respond," later today. According to the suit…

Kristin Henrikson works for the EGFD and is married to Fire Chief Peter Henrikson.
East Greenwich Fire District employee Kristin Henrikson filed a second suit against the district and the firefighters union late last week, this time in state court. Henrikson filed a lawsuit in federal court against the district, the union and the former fire chief in September 2011. Henrikson, chief clerk for the Fire District, is married to Fire Chief Peter Henrikson. In the new complaint, the EGFD and the union are accused of failing to provide Henrikson with fair representation. Unions are required to provide what’s known as “fair representation” of all union members — to represent all employees fairly, in good faith, and without discrimination. According to the complaint, the union failed to represent Henrikson after the district …

From a DUI story that made national headlines to a tempest in a farmyard teapot, EG had lots of interesting news stories in 2011.
1. State Representative Bob Watson’s arrest and its fallout is still being felt, eight months after the fact. Watson, who represents East Greenwich and served as House minority leader at the time, was arrested for driving under the influence and possession of marijuana after he was stopped in a DUI checkpoint in New Haven, Conn., last April. Watson admitted to having the bag of marijuana but has said that he did not smoke it nor had he had too much to drink the night of the arrest. He said that he used the marijuana for medical purposes but had not registered with the state as a medical marijuana user. The subsequent firestorm prompted Watson to resign his majority leader position, but he has steadfastly maintained his innocence. Blood …

Fire District files its answer as well.
The East Greenwich Fire Fighters Association, Local 3328, filed a motion to dismiss Tuesday in the lawsuit filed by Kristen Henrikson against the union, individual EG Fire Commissioners, former Fire Chief John McKenna and the Fire District itself, claiming job discrimination. Henrikson is the wife of current Fire Chief Peter Henrikson and works as a clerk for the District. In her lawsuit, Henrikson said that she was discriminated against when she was not offered a fire fighter’s position in 2009. She first filed a complaint with the state Commission of Human Rights, in March 2010. In March 2011, the commission determined there that no probable cause existed to believe that the Fire District had violated state and federal anti-…

Keith and Wendy Amellotte say that damage to their house has been caused by demolition of the old and construction of the new Cole Middle School.
A third homeowner has joined a lawsuit against the town, school department and a variety of construction-related entities for damages they claim were caused by the construction of the new Cole Middle School. The original lawsuit was filed seven months ago. Keith and Wendy Amelotte of 35 Sarah’s Trace join Chris and Susan Lamendola of 50 Sarah’s Trace and Thomas Hogan and Cynthia Peloso of 40 Sarah’s Trace in the lawsuit. Sarah's Trace lies just west of the middle school property. Homeowners on Lillibridge Drive, another adjacent street, have also complained about construction vibrations but none have joined the suit. “We actually contacted the superintendent’s office the summer of 2010 when we had seen enough damage to say that there’s …

Kristen Henrikson says she was unjustly passed over for a fire fighter job
The wife of EG Fire Chief Peter Henrikson has filed suit against the Fire District, former Fire Chief John McKenna and the fire fighters union, arguing that she was discriminated against when she was not offered a fire fighter’s position in 2009. Kristen Henrikson is chief administrative clerk for the Fire District and reports to the Fire Commissioners, an elected body. She has worked for the district for 14 years. “The suit was initiated before her husband became chief,” said Bill Conley, the lawyer representing Henrikson. Chief Henrikson said only, “It’s an issue between her and the Fire District.” According to the complaint, which was filed in federal District Court Aug. 23, former Chief McKenna had posted the job of fire marshal to all…

Two homeowners filed suit in February claiming that construction vibrations damaged their houses.
Seven months after homeowners filed suit against the School Department and various construction entities connected to the building of the new Cole Middle School, the case is slowly moving through the initial “discovery” phase. Depositions - legal interviews - will begin in September, schools lawyer Matt Oliverio said. According to Oliverio, a trial - if it comes to a trial - is years away. Chris and Susan Lamendola, of 50 Sarah’s Trace, and Thomas Hogan and Cynthia Peloso, of 40 Sarah’s Trace, filed suit against the town, the School Department, Gilbane Construction and Strategic Building Solutions, among other parties, last February. They are arguing that their houses have been damaged as a result of the construction at Cole Middle School…

Homeowners want increased seismic monitoring; the case will return before a judge on
Thursday, April 28.
The lawyer for two homeowners who filed suit against the town and Gilbane Construction because they say their houses have been damaged as a result of the construction of the new Cole Middle School filed a motion for an injunction to halt the project Wednesday. The action comes just as the new school prepares to open and work on the third phase of the project - demolition of the old Cole and construction of a parking lot and playing fields - is slated to begin. Lawyer David Maglio filed the motion on behalf of Christopher and Susan Lamendola of 50 Sarah’s Trace and Thomas Hogan and Cynthia Peloso of 40 Sarah’s Trace. According to the EG School Department’s lawyer, Matt Oliverio, the homeowners want additional seismic monitoring to be done…
